Acceptance of Terms

By accessing and using the MAK-AI Data Portal (the "Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Platform.

Description of Service

The MAK-AI Data Portal is an open data platform that provides access to datasets, research materials, and AI-related resources. The Platform is operated by MAK-AI ("we", "us", "our") and serves researchers, students, developers, and the general public interested in artificial intelligence and data science.

The Platform provides both public access to open datasets and restricted access to gated datasets that require approval for use.

User Accounts and Registration

To access certain features of the Platform, including gated datasets and premium services, you may be required to create a user account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Acceptable Use Policy

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform:

• To violate any applicable local, state, national, or international law or regulation
• To transmit any material that is abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or invasive of another's privacy
• To impersonate or attempt to impersonate any person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Platform
• To use any manual or automated software, devices, or other processes to scrape or download data from the Platform without permission
• To attempt to gain unauthorized access to any systems or networks connected to the Platform

Data Usage and Licensing

Open Data

Datasets marked as "open" or "public" are available under various open data licenses (Creative Commons, Open Data Commons, etc.). When using open data, you agree to:

• Comply with the specific license terms for each dataset
• Attribute the data source appropriately as required by the license
• Use the data in accordance with the license restrictions (if any)

Gated Data

Access to gated datasets requires approval from dataset owners or administrators. By requesting access to gated data, you agree to:

• Use the data only for the purposes stated in your access request
• Comply with any additional terms specified by the dataset owner
• Maintain confidentiality of sensitive or restricted data
• Report any security incidents or unauthorized access immediately

Intellectual Property Rights

The Platform and its original content, features, and functionality are and will remain the exclusive property of MAK-AI and its licensors. The Platform is protected by copyright, trademark, and other laws. You may not duplicate, copy, or reuse any portion of the HTML/CSS, JavaScript, visual design elements, or concepts without express written permission from MAK-AI.

However, datasets and content made available through the Platform are licensed according to their respective licenses, which may allow for reuse and redistribution.

User-Generated Content

If you upload datasets, comments, or other content to the Platform, you retain ownership of your content but grant MAK-AI a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Platform.

You are solely responsible for the content you upload and warrant that:

• You own or have the necessary rights to upload the content
• The content does not violate the rights of any third party
• The content complies with applicable laws and regulations
• The content does not contain malicious code or harmful components

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

Disclaimers and Limitations of Liability

The Platform is provided on an "as is" and "as available" basis. MAK-AI makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, or materials included therein.

To the fullest extent permissible by applicable law, MAK-AI disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

MAK-AI will not be liable for any damages of any kind arising from the use of this Platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

The datasets and information provided through the Platform are for informational purposes only. MAK-AI does not warrant the accuracy, completeness, or usefulness of any dataset or information.

Indemnification

You agree to indemnify and hold MAK-AI harmless from any claims, damages, losses, costs, and expenses (including legal fees) arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Platform will cease immediately. If you wish to terminate your account, you may simply discontinue using the Platform.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be interpreted and governed by the laws of Uganda, without regard to conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the Kenyan Arbitration Act.

Before initiating arbitration, you agree to first contact us at info@mak-ai4d-hub.org to seek a resolution.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Platform after any revisions become effective, you agree to be bound by the revised terms.

If you do not agree to the new terms, you are no longer authorized to use the Platform.
